Federal Court Blocks Donald Trump’s Push for Mass Immigrant Detention Without Bail

In a significant setback for the Trump administration’s immigration agenda, a federal appeals court has struck down a broad effort to detain millions of immigrants without the possibility of release, including individuals with no criminal history and long-standing ties to the United States. In a unanimous 3–0 ruling, the U.S. Court of Appeals for the Second Circuit determined that ICE’s policy relies on a legally flawed and unprecedented interpretation of immigration law, cautioning that it could raise serious constitutional issues. Judge Joseph Bianco, a Trump appointee, was blunt in his assessment. He wrote that the government’s interpretation would send a “seismic shock” through the immigration detention system and society as a whole. He warned it would put further strain on already overcrowded facilities, separate families, and disrupt communities nationwide. He added that if Congress intended such a sweeping change, it would not have done so in such an indirect and unclear manner. Bianco was joined by Judges José Cabranes and Alison Nathan, making the decision unanimous and marking the first time a federal appeals court has rejected the administration’s aggressive stance on detention. At the center of the case is a controversial ICE policy introduced under the direction of Todd Lyons, which aimed to classify nearly all immigrants facing deportation as “applicants for admission.” This designation would require mandatory detention without bond, breaking with decades of legal precedent. Historically, both Democratic and Republican administrations limited mandatory detention to more recent border crossers. Immigrants already living in the U.S., often for years, were generally allowed to request bond hearings before being detained. The administration’s reinterpretation overturned that approach, prompting a wave of legal challenges across the country. Courts have been flooded with emergency filings from immigrants suddenly detained despite having deep roots in their communities, including U.S. citizen spouses and children. The judicial response has been overwhelmingly critical. By current counts, hundreds of federal judges have ruled against the policy as unlawful and unconstitutional, with only a small number of Trump-appointed judges siding with the administration.
